The Monument Hotel Terms & Conditions.

The following Terms &Conditions apply to all bookings made for The Monument Hotel, owned, andmanaged by KingMonument Exploitatie B.V.. By holding a reservation with The Monument, the guest agrees to thefollowing terms and conditions.  We kindly ask that you take amoment to read them prior to making a booking.

In these Terms & Conditions, the followingdefinitions apply:

1. Definitions

“Company” or “we” means TheMonument Hotel, owned, and managed by King Monument Exploitatie B.V..

“Booking” means the booking(reservation) for accommodation, functions and/or any other services or itemsmade with us.

“Contract” means the booking and these Terms, and any other Terms and Conditionsstated to apply to the booking.

“Hotel” means the premises for which your booking is made.

“Terms” means these Terms and Conditions.

“Websites” means www.themonument.nl or any other affiliated websitewhere it is possible to make a booking at The Monument.

“BTW” means value added tax.

2. Bookings

2.1 All bookings made for TheMonument hotel are subject to these Terms and Conditions.

2.2 The Monument retains the right to cancel or denyany booking.

3. Charges

3.1 The prices displayed on the websitesare an average per night per person until a room selection has been made. Aminimum length of stay,  cancellationcharge and other conditions may apply to certain rates, as specified.  Oncea rate is selected on the websites, the total for your requested stay shall bedisplayed on the reservation summary.  Prices shall be charged in thelocal currency of the hotel (€) and any currency conversion facility isprovided as an approximation tool only.

                                           

3.2 The BTW breakdown shown isindicative based on the current rate of BTW, and the expected BTW treatment ofthe goods or services.  BTW will be payable at the prevailing rateapplicable at the tax point of the invoice or booking confirmation issued andmay change depending on the actual rate and the BTW treatment of the goods andservices purchased at that date.

3.3 City tax applies to everyperson staying a night in the hotel. The city of The Hague has set the rate ofthe city tax in 2022 at € 5,35 per person per night. This tax is due onarrival. Children younger than 13 years do not have to pay the city tax. TheMonument is not responsible for any change in the rate the city councilenforces upon the city of The Hague.

3.4 The prices of dormitoriesand/or private rooms may fluctuate from day to day. The Monument is notresponsible for any changes in prices or any deviance between on-line pricesand reception prices.

4. Check-in/Check-out Requirements

4.1 In the interests of security andfraud prevention, at the time of check-in, guests may be required to confirmtheir identity by providing their booking reference, passport, identity card ordriving licence.

4.2 Unless otherwise stated onthe booking confirmation, guests may check-in any time from 3.00 p.m. (15:00) onthe scheduled day of arrival until 10.00 p.m. (22.00).  All rooms thathave been secured by credit/debit card, or prepaid at the time of booking, willbe held until 10 p.m. (22:00) on the scheduled day of arrival, unless otherwisedirectly agreed with the hotel.  Any non-secured reservation will be helduntil 6.00 p.m. (18.00) on the day of arrival, at which time we will beentitled to release the room into open sale, unless the guest has notified the hotelof a late arrival.

4.3 On the day of departure, weask all guests to vacate their rooms by 11.00 a.m. If a guest does notcheck-out before 11.00 a.m., The Monument remains the right to charge an extranight’s stay.

4.4 Rooms are subject to maximumoccupancy rules set by the hotel. If you would like further details, pleasecontact the Hotel.

4.5 The Monument does not allowguests of dormitories to check-in after 11.00 p.m. out of respect for the nightrest of the other guests.

4.6 We have a tourist only policyat The Monument. It is at the liberty of The Monument staff to cancel a guestbooking at any time, providing the situation requires this.

4.7 With regards to long staybookings, arrangements can be made with management. Without prior contact andagreement, the maximum duration of one guest’s stay shall be 7 nights.

5. Payment

5.1 The Monument accepts the following methods of payment: cash, bank transferor credit card.

 

5.2 The Monument accepts the following credit cards: MasterCard, VISA, Maestro,Visa Electron and V-pay.

5.3Payment for the entire booking will be collected at check-in. If partially paidbefore arrival, the remaining balance will be completed at the reception. Iffully paid prior to arrival, only the city tax will be collected at check-in. Whenextending a booking, the payment should be done before the foregoing bookingexpires.

 

5.6 No guest shall be permitted to stay without full payment for theirbooking.

6. Cancellation Policy and NoShows

6.1 The cancellation policy willvary per booking method.

6.2 When making a bookingdirectly at the reception, after the point of payment, no refund shall begranted.

6.3 All bookings made via www.TheMonument.nl are non-refundable. However, when a booking is made via the website of thehotel, when occupation allows, it is possible to select a different date foryour stay and this must be discussed with The Monument staff. In case of ano-show, without contacting the hotel, there will be no refund or differentdate.

6.4 Regarding bookings made via booking.nl, we havethe right to charge the provided credit card with the total amount of thereservation as soon as the booking is made. However,  it may happen that we did not charge thegiven card details before arrival. In that case the booking shall be paid onarrival. In case of a no-show with non-refundable rates, the total amount ofthe booking will be charged on the provided credit card.

6.5 We have the right to charge your credit carddetails when you book via Expedia. In case of a no-show the full amount of thebooking will be charged.

6.6 For the group booking cancellation policy,please read article 18.4.

 

7. Changes or Cancellation by the Company

7.1 In the circumstance where TheMonument needs to cancel a guest booking, a full refund will be provided. TheMonument holds no further liability for situations arising out of such acancellation. The Monument may, however, use reasonable endeavours to try andre-locate any confirmed booking, cancelled by us, to an alternative locationsimilar in standard to the hotel.

7.2 All bookings are made for a roomtype in the hotel. If the guest has indicated a room preference at the time ofbooking, The Monument will use reasonable efforts to honour this. However,there is no guarantee that the guest will be able to stay in the specific roomor bed selected; applying equally throughout the duration of the stay, meaninga room or bed change may be necessary. These changes may be due to operationalor safety reasons and if the guest is allocated to a room with a lower ratethan originally selected, The Monument will refund the difference in roomrates.

8. Damage

8.1 The Monument reserves theright to charge a guests’ debit or credit card for any damage incurred duringtheir stay, and the guest hereby authorises The Monument to make this chargewhen necessary. Damages pertain to the room, hotel or for missing property,with the inclusion of specialist cleaning costs.

9. Parking

9.1 The Monument has limitedparking opportunities and therefore, cannot guarantee a guest a parking spaceunless otherwise corresponded. Parking cannot be reserved online and therefore;the guest must have had prior contact with The Monument if they wish to park.

9.2 Parking will be from check-in(15.00 p.m.) until check-out (11 a.m.) with a charge of € 25,- per night. Whendiscussed with the reception, extra charges may apply when extending theduration of the parking.

9.3 We do ask that the guestleave the keys of a car at the reception in case of an emergency or a changingof the parking spots.

9.4 Cars and their contents areleft at the owner’s/guests own risk. The Monument does not accept responsibilityfor loss or damage.

 

10. Hotel etiquette: The Monument house rules

10.1 Guest Behaviour. At all times, guests are required to conduct themselves appropriately andto comply with The Monument’s company procedures. Moreover, guests must act inrespectful manner, by not causing offence or harm to other guests or employees,not disrupting the hotels procedures and or comfort and enjoyment of otherguests. This includes requests from staff regarding behaviour and cleanliness,and respect for property, employees, guests and their health and safety. When aguest has broken these etiquette requirements, The Monument retains the rightto refuse accommodation and or services from the person or persons in question.Furthermore, The Monument will provide no refund for the remaining nights of aguests stay and hold no liability for the loss of services if the above rulehas been broken.

10.3 Hotel etiquette; The thing that sets a hotel apart from any other form of accommodation isthe social aspect. For everyone to enjoy The Monuments facilities, there are afew things to consider.

10.3.1 Respect; The Monument has guests from all parts of theworld and so requires each guest to respect all cultures, religions, and sexualorientations. Failure to do so will result in termination of booking with norefund.

10.3.2 Night-time; After 23.00pm The Monument requires all commonareas, hallways, and rooms to be quiet.

10.3.3 Around the hotel; When arriving late at night, The Monument asksall guests to respect the neighbours and local area by minimising the noise atthese times.

10.3.4 No Smoking; smoking inside the hotel is prohibited. Failureto abide by this rule, will lead to termination of booking with no refund andimmediate removal from the hotel. If the fire alarm is incorrectly activated(i.e. due to smoking inside) there will be a fine of €250, payable by theperson or persons responsible for activating the alarm.

10.3.5 Soft drugs; due to The Monumentbeing located in the Netherlands (where soft drugs are legally sold in certainestablishments); certain liberties apply when considering the use of soft drugs.Therefore, The Monument holds a tolerance policy when it comes to the use ofsuch drugs. This means that soft drug use is not strictly prohibited in thesmoking area of the hotel. It is however, not allowed to; smoking soft drugsinside or in front of the hotel, prepare soft drugs to be smoked in the commonareas of the hotel. Where staff believe this rule has been disrespected, theguests booking will be terminated, with no obliged refund.

10.3.6 Hard drugs; All hard drugs are strictlyforbidden! In the case that a guest is seen with or using hard drugs, or whenreasonable suspicion has been raised regarding this clause, the booking will beterminated with no refund.

10.3.7 Extra Guests; Bringing extra guests into the hotel is strictlyprohibited. When this rule is broken, the guest will be charged the full pricefor the extra person.

11. CCTV

We have a fully functioning camera system running24 hours a day for your and our security. We have the right to use our ownfootage in whichever way it is needed.

12. Children

All children (a person under 18 years of age) staying at the hotel must beaccompanied and supervised by an adult and remains the responsibility of thisadult for the entire stay.

Cots and extra beds are available in most of our rooms. However, these arelimited and subject to availability. Additional charges may apply.

13. Pets

No pets allowed.

14. Force Majeure

The Monument accepts no liability and will not pay any compensation wherethe performance of its obligations is prevented or affected directly, orindirectly, by or as a result of, force majeure. Thisalso applies to any circumstances beyond its reasonable control including, butnot limited to, flood, pandemic, earthquake, extreme adverse weatherconditions, natural disasters, other acts of God, acts of terrorism, fire orfailure of electric power, gas, water, or other utility service, plantmachinery, computers, electronics, vehicles, or any collapse of beds and/or buildingstructures.

15.Limitation of Liability

The Monument will not be responsible for theloss or damage of any property left in the hotel.

 

The Monument will not be liable for anyindirect, consequential, or pure economic loss, or any loss of profit, goodwill,or opportunity (whether caused by the negligence of the company, its employees,contractor or agents or otherwise). The company’s total liability shall notexceed the value of the charges received by it under the Contract.

 

Nothing contained in the Contract or in anyother document referred to or incorporated in it shall be read or construed asexcluding any liability for death or personal injury caused by the company’snegligence or liability for fraud or fraudulent misrepresentation.

16. Web Site Information

While all reasonable efforts have been taken to ensure the accuracy ofinformation on the websites, The Monument does not accept responsibility forerrors or omissions, and reserves the right to amend, cancel or vary any of thearrangements featured on the websites without notice. Please note that incertain circumstances, generic photographic images may have been used torepresent the general style of a particular product or hotel.

The content of the websites is the copyright of TheMonument, and may not be copied, reproduced, published, distributed, or amendedfor any other purpose without our prior written consent.

 

Trademarks used on the websites are the propertyof the respective owners. Hyperlinks to third party websites are provided foryour convenience. We cannot accept responsibility for the content or use of third-partysites.

17. Baggagestorage

On the day of arrival, guests are permittedto drop baggage at the hotel prior to check in time from 8.00 a.m. onwards.Guests will be asked to collect their luggage on the day of check out before 10.00p.m. (22.00) unless agreed with The Monument staff beforehand. When baggage isnot collected after 72 hours (with no prior agreement), The Monument holds noresponsibility for holding the luggage.

Long-time storage (more than 18 hours)will only be possible when discussed with the personnel and charges may apply.

The Monument will not be responsible forthe loss or damage of any property left in the hotel.

18. Groups

18.1. Definition

Any reservation with +4 individual guests isconsidered a group reservation. The same terms & conditions apply as forall bookings, according to our full terms and conditions - with the followingadditions:

18.2. Confirmation & Payment The confirmation invoice you havereceived from us does not act as proof of reservation but as an offer. Youroption becomes a confirmed reservation when payment has been completed no laterthan max. 30 days before check-in date.

18.3. Damages For any damage to or soiling of our propertyprovably incurred by members of a group we reserve the right to charge repairor cleaning costs to individual members of the group or the reservation holder.

18.4. Room Allocation and Pricing We reserve the right to allocatethe beds and rooms in our properties to the best possible fit, or as we seereasonable. We do not offer accommodation for groups in the same room withindividual guests, as this may cause misunderstandings and inconvenience withall parties involved

 

 

18.5. Cancellation Free/refunded cancellation for the entirereservation is possible until 30 days before checkin date. Cancellation between30 and 15 days before check-in date results in a %50 cancellation fee on thetotal amount. For cancellations requested 15 days before check-in date or laterthere is no possibility for a refund. Refunded cancellation for individual bedsof a group reservation is not possible, however the amount for the city taxsurcharge can be adapted when you arrive with less guests than planned.

18.6. Force Majeure Cancellations reasoned with Force Majeure orhigher powers do not pose an exception to the cancellation policy definedabove. This includes any rules or regulations concerning COVID-19 or any otherdiseases, travel restrictions, local, national or global restrictions. Allcancellations made for any imaginable reasons (including pandemic or diseaserelated) abide to the deadline for eligible refunds until 30 days prior tocheck-in.

18.7 Onlinereservations; The Monumentdoes not accept reservations for more than 4 people via our affiliated bookingwebsites (for example, booking.nl) as The Monument cannot guarantee compliantroom allocation. When a guest has made a group reservation through anaffiliated site, the guest may be asked to cancel the reservation in order tocontact The Monument directly. Once The Monument has made this request, it isup to the guest to follow this procedure, The Monument holds no responsibilityto track the status of this and will proceed with the group booking whencontacted directly.

4. The personal data  that are collected on the website are used mainly by the controller in order  to maintain a(commercial) relationship with you and if applicable in order to  process your orders. They are recorded in an(electronic) register.

       Article 7 - Your rights regarding information  

    1. Pursuant to Article  13 paragraph 2 sub b GDPR each data subject has the right to information on  and access to, and  rectification, erasure and restriction of processing of his  personal data, as well as the right to object to the processing and the right to data portability.  

2. You can exercise  these rights by contacting us at reception@themonument.nl.  

3. Each request must  be accompanied by a copy of a valid ID, on which you put your signature and  state the address where we can contact you. 

    4. Within one month of  the submitted request, you will receive an answer from us.  

5. Depending on the  complexity and the number of the requests this period may be extended to two  months.

 

    Article 8 - Legal obligations  

    1. In case of infringement  of any law or regulation, of which a visitor is suspected and for which the  authorities require  the personal data collected by the controller, they will be  provided to them after an explicit and reasoned request of those authorities, after which these personal data do not fall  anymore under the protection of the provisions of this Privacy policy.

2. If any information  is necessary in order to obtain access to certain features of the website,  the controller will indicate the mandatory nature of this information when requesting these  data.  

    Article 9 - Collected data and commercial offers  

    1. You may receive  commercial offers from the controller. If you do not wish to receive them  (anymore), please send us  an email to the following address: reception@themonument.nl.  

2. Your personal data will not be used by our partners for  commercial purposes.

If you encounter  any personal data from other data subjects while visiting our website, you  are to refrain from collection, any unauthorized use or any other act that  constitutes an infringement of the privacy of the data subject(s)in question. The controller is not responsible in these  circumstances.

The collected data are used and retained for the duration  determined by law.

    These conditions are governed by Dutch law. The court in the  district where the controller has its place  of business  

has the sole jurisdiction if any dispute regarding these  conditions may arise, save when a legal exception applies.
